The use of this site is governed by the terms and conditions set
forth below.
Please read all of these terms and conditions carefully as the use of
this site and ordering of products through this site indicate your
acceptance of all of these terms. If you do not agree with these terms

right to modify, alter, or update all or any part of these site terms at

SUMMARY
Returns: Exchanges and returns for store credit can be made within 7 days. Merchandise with
manufacturer defects will be fixed or replaced and non defective items
are subject to a 20% restocking fee. Shipping is never refunded. All
returns require an RMA number available by emailing
rma@simoncells.com.
NOTE: A phone's box that has a broken manufacturer seal is not
considered to be a defect. Since most of our phones come from out the
US, boxes are often opened by customs inspectors. Returning a phone
because the seal is broken will incur a 20% restocking fee.
Shipping:
SimonCells.com ships within the United States only. For your protection,
all UPS shipments require a customer signature upon delivery. Expedited
shipping is available by UPS only. Most non Bluetooth accessories may
be shipped by the USPS. Only USPS orders can be sent to APO and PO Box
addresses. All orders are considered submitted only after they are
approved by our verification department. Verification is performed
immediately during business hours (please check our holiday
scheduled). Once your order has been approved, it will ship via the
shipping method you specified during the checkout process.
Payment:
SimonCells.com accepts credit cards issued in the United States with
U.S. billing and shipping addresses. Payment can also be made by bank
wire transfer. All orders are subject to address verification and
are not considered as submitted until the verification process is
concluded.
Merchandise: Customers are responsible for
determining item compatibility with their phone service provider and
device manufacture prior to purchase. Some phones come
with international chargers and/or non English manuals. SimonCells.com
will always include a U.S. prong adaptor with your order and English
manuals can be downloaded by request. Many items come with a one year
manufactures warranty, but some do not. Please contact the manufacture
for warranty information or email

your specific item.

specifications for the products we offer. However, on occasion, we do
make mistakes. In the event that a product is listed at an incorrect
price or with incorrect information due to a typographical error or
misinformation received from our suppliers, SimonCells.com retains the
right to refuse or cancel any such orders whether or not the order has
been processed. If your credit card has been charged for the purchase
and your order is canceled, SimonCells.com will immediately issue a
credit to your credit card account in the amount of the charge. Pictures

ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation
does not signify our acceptance of your order, nor does it constitute
confirmation of our offer to sell. To prevent the fulfillment of
fraudulent orders, all orders are screened and verified before they are
accepted by our warehouse and approved for shipping. This process begins
immediately during business hours and orders are not considered as
submitted until verification can be obtained. The amount of time needed

Please email

any questions. SimonCells.com will charge a 20% restocking fee if you
return a non defective item even if it the item is not compatible with
your phone service provider and/or another device.
GSM services can use 850MHz, 900MHz, 1800MHz, 1900MHz, UMTS(2100MHz),
and 3G frequencies. Please check with your service provider to
determine which frequency or frequencies are needed in your area. World
GSM Frequencies
Verizon, Sprint, and Nextel customers: The GSM phones sold on
www.SimonCells.com are not
compatible with your service. Only phones listed with your carrier in
the product description will work with your service.
If you do not know the type of phones needed to work with your
service provider please call them and verify what phones and features
are compatible with your service.
Please note that not all features such as “push to talk” PTT or
“EDGE” are supported by all carriers for all phone models.

SimonCells.com accepts all major credit cards, including Visa®,
MasterCard®, American Express®, Discover®, and Diners Club®. Please be
sure to provide the exact billing address and phone number as it appears
on your credit card statement and include the phone number registered to
your shipping address if applicable. Incorrect information may cause a
delay in processing your order. Shipping and billing addresses are
subject to verification.
Credit card information may be submitted on the website using our
secure server www.simoncells.com or customers may call our
customer service representatives with payment information. SimonCells.com
will never request or process credit card information through email.
In some cases SimonCells.com may request that an order be paid for by
bank wire transfer. Customers may also elect to pay by bank wire
transfer and can do so by emailing or calling our customer service
representatives.
SALES TAX
SimonCells.com only collects local sales tax on orders shipped within
New York State. For areas outside of New York State please check with
your local tax authorities regarding any local sales tax liabilities.
SHIPPING
SimonCells.com only ships within the continental United States,
Alaska, and Hawaii. Orders for in stock items placed and verified by 10:00am EST
generally ship within 24-48 hours Monday-Thursday. Some orders may take up to
two business days to process. Actual shipping time is contingent upon
availability of merchandise and credit verification. No orders are
processed or shipped on Saturdays or Sundays. In the event of delays
every effort will be made to contact you by phone or email. If the delay
is due to backorder, you will receive notice and be given the choice to
remain on backorder, substitute another item, or cancel your order
without penalty.
Most non-BlueTooth® accessories can be shipped by the USPS with
delivery confirmation. Packages can take up to ten business days for
delivery. All other items are shipped via UPS with a signature
required at time of delivery. Simoncells.com may change shipping
carriers without notice. Orders are subject to the terms and conditions
of the USPS (www.usps.com),
UPS (www.ups.com),
or any other carrier. Refunds are not issued for delivery delays due to
weather or other occasions not controlled by the shipping carrier.
Special delivery services such as Saturday Delivery, Early AM, Next Day
Air, etc are NOT available for all zip codes and SimonCells.com does not
guarantee these delivery services.
If your package appears damaged or is taped with plastic or duck
tape, please refuse the package. SimonCells.com will start an
investigation and attempt to receive credit from the shipping company
responsible for the damage. If you were unable to refuse the package,
call or write SimonCells.com immediately, and save all parts of the
package for the shipping carrier to inspect. Customers must cooperate
with SimonCells.com and the shipping carriers’ investigation in order to
receive credit or a replacement for any items lost or damaged in
transit.
If a package is refused, not signed for, or sent to the wrong address
because of a customer error the customer may be charged for the refusal,
to reship the item, or to redirect the package. If the item can not be
redelivered or the customer can not be contacted SimonCells.com will
refund the customer minus the shipping costs and a 15% restocking fee
once the package has been retrieved.
ORDER CANCELLATION
An order that has shipped can NOT be canceled. All orders
submitted to SimonCells.com by phone or on the website are subject to a
10% cancellation fee. Customers may cancel their order by email or by
calling a customer service representative. Canceling an order does not
guarantee that the order will not be processed, but SimonCells.com will
do everything we can to prevent this from happening. Cancellation fees
are never charged when a customer cancels an order for an item on
backorder, when the product description is incorrect, or price changes
occur.
If a package is refused, not signed for, or sent to the wrong address
because of a customer error the customer may be charged for the refusal,
to reship the item, or to redirect the package. If the item can not be
redelivered or the customer can not be contacted SimonCells.com will
refund the customer minus the shipping costs, applicable penalties, and
a 15% restocking fee once the package has been retrieved.

RETURNS AND EXCHANGES / DEFECTIVE
MERCHANDISE

to receive a return merchandise authorization (RMA) number and
instructions.
Packages without a proper RMA
number are subject to a 20% restocking fee and will result in a store credit issued to the customer for the evaluated value of the return. All non "defective" returns are
subject to a 20% restocking fee.
SimonCells.com will service or replace
defective, returned merchandise with the exact model or a comparable
model, at our discretion within 7 days. "Defective" is defined
by the manufacture warranty. After 7 days customers must contact the
manufacture directly. Please contact the product manufacture for the
most accurate information regarding their warranty and support policies.
SimonCells.com accepts exchanges and returns for store credit when the following conditions are met:

The package must have a valid RMA number on the
address label.

The RMA number must be requested within 7 days from
when the item was received.

SimonCells.com must receive the return within 7 days
from when the RMA was issued.

The equipment must be returned in brand new
condition, with all components in its box, and there should be no
cosmetic or internal damage to the unit and its components.
Merchandise must be in original factory condition including all
packaging materials inserts and manuals, warranty cards (not
filled-out) and all accessories. Product packaging must be
unaltered. The equipment may not be registered with its manufacture.
Software CDs must be sealed. The unit must have less than thirty
minutes of talk time.

The customer’s invoice or order number must be
included in the package along with an explanation for the return.
A 20% restocking fee will be
charged for every return.

taped-on contents or cartons. We reserve the right to refuse any
returns.
Please note that an RMA number does not guarantee final
disposition. All returns are subject to inspection.
Please ship your parcel back to us freight prepaid. We
suggest that you use UPS Ground Service "Insured." Sorry, we
cannot accept COD or freight-collect shipments.

The following guidelines are available to you as a resolution
when in need of assistance :
1) DEFECTS - If the customer's product has a manufacturers
defect, the customer may obtain an RMA within 7 days of purchase
and return the product. SimonCells.com will ship a replacement
at no additional cost.
2) SETUP - If the product is non-defective and the issue is a
technical setup procedure supported by the users manual,
SimonCells.com will adjust the product according to the
product's user manual and ship the product back to the customer.
The customer will be charged a $10.00 fee for this service plus
the expense of return shipping.
3) RETURNS - Customers may return non-defective products that
are in new condition for any reason within 7 days of purchase for store credit, a
20% restocking fee will be charged. |

cost. When prices are lowered we will pass the savings on to you. If a
price goes up we may be obliged to increase our price. All prices and
